1. Acceptance of Terms

By engaging our services, submitting a project inquiry, or signing a service agreement with Brandlynk Digital Solutions, you agree to be bound by these Terms of Service. If you don't agree with any part of these terms, please don't use our services.

These terms apply to all services including web design, web development, mobile app development, SEO, digital marketing, and any other digital services we provide.

2. Our Services

Brandlynk Digital Solutions offers comprehensive digital services including:

• Review deliverables and provide feedback within agreed timeframes (typically 5 business days)
• Ensure you have legal rights to all materials provided to us
• Maintain clear communication and respond to our inquiries promptly
• Provide necessary access credentials (hosting, domains, etc.) when required

4. Payment Terms

Payment Structure

Unless otherwise agreed in writing, our standard payment terms are:

• 50% Deposit: Due upon project commencement to secure your spot in our schedule
• 50% Final Payment: Due upon project completion and before final delivery

Payment Methods

We accept payment via bank transfer (M-Pesa, bank deposits), mobile money, or as specified in your invoice. All fees are quoted in Kenyan Shillings (KES) unless otherwise stated.

Refund Policy

Initial deposits are non-refundable as they cover planning, research, and resource allocation. However, if we're unable to deliver the agreed services, we'll work with you to find a fair solution/Refund.

5. Project Timeline & Delivery

We provide estimated timelines for each project based on its scope and complexity. While we strive to meet all deadlines, timelines are estimates and may be affected by:

• Delays in receiving required materials or feedback from you
• Changes to project scope or requirements
• Technical challenges or third-party dependencies
• Force majeure events beyond our control

We'll always communicate any potential delays and work to minimize their impact on your project.

6. Intellectual Property Rights

Your Content

You retain all rights to content, materials, images, and information you provide to us. By providing these materials, you grant us a license to use them for your project.

Our Work

Upon full payment, you'll receive full ownership of the custom design and code we create specifically for your project. This includes:

• Custom website designs and layouts
• Custom-written code for your project
• Graphics and assets created specifically for you

Third-Party Elements

Your project may include third-party elements such as:

• Open-source frameworks and libraries
• Stock photos or fonts (which may require separate licenses)
• Third-party plugins or tools

These elements remain subject to their respective licenses. We'll ensure all necessary licenses are properly obtained.

Portfolio Rights

We reserve the right to showcase your project in our portfolio and marketing materials unless you request otherwise in writing. We're proud of our work and love sharing success stories!

7. Warranties & Support

Quality Guarantee

We guarantee that all work will be completed professionally and to industry standards. We'll fix any bugs or errors in our work free of charge within 30 days of project completion.

Support Period

All projects include a 30-day support period after launch, covering:

• Bug fixes and technical issues
• Minor content updates
• Technical guidance and assistance

Extended Support

We offer ongoing maintenance packages for clients who need continued support, updates, and monitoring. Contact us for details on our maintenance plans.

8. Limitation of Liability

While we strive for excellence, we cannot guarantee that our services will be error-free or uninterrupted. To the fullest extent permitted by law:

• Our total liability is limited to the amount paid for the specific service in question
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for data loss, revenue loss, or business interruption
• We are not liable for issues arising from third-party services, hosting, or plugins

You are responsible for maintaining backups of your content and data.

9. Termination

Termination by Client

You may terminate the project at any time by providing written notice. In such cases:

• You remain responsible for payment for work completed to date
• Initial deposits are non-refundable
• We'll provide all work completed up to the termination date upon receipt of final payment

Termination by Brandlynk

We reserve the right to terminate a project if payment terms are not met, if you fail to provide necessary materials after multiple requests, or if we believe continuing the project is not in either party's best interest. In such cases, you'll receive a refund for any unused portion of payments minus work already completed.

10. Confidentiality

We understand that your business information is valuable. We commit to:

• Keep all your confidential information secure
• Not disclose your information to third parties without permission
• Use your information solely for providing the agreed services

For projects requiring additional confidentiality, we're happy to sign a separate Non-Disclosure Agreement (NDA).

11. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices or for legal reasons. We'll notify existing clients of any significant changes via email.

Continued use of our services after changes are made constitutes acceptance of the updated terms. The "Last Updated" date at the top of this page indicates when the most recent changes were made.
